Know Your Contract Transfers When a position is open for transfers, how is the finalist selected? ARTICLE 7 – Transfers
Article 7-6 Requests for transfer shall be considered on the basis of qualifications for the position desired. In filling a vacancy, the District will take into account the program needs of the District and will consider, among other things: 1. The teacher’s endorsement area(s); 2. The teacher’s certification; 3. The teacher’s experience, including length of service in the District and the most recent teaching experience; 4. The teacher’s educational preparation and training; and 5. Whether such change in assignment is educationally sound.
WEA ESP Staff: Similarly, the ESP contract provides: ARTICLE 7 – Transfers 7-1 Requests for transfer shall be considered on the basis of qualifications for the position desired. In filling a vacancy, the District will take into account the program needs of the District and will consider, among other things: 1. The skills desired for the position; 2. The employee's experience, including length of service in the District and the most recent work experience; and 3. The employee's educational preparation and training. Both of these provisions are known as “modified seniority” clauses. That is, the contract provisions require the district to consider the seniority of an applicant for transfer in making their decisions. If a less senior person is selected, you should contact the administrator about why the less senior person was selected. If you are not satisfied with the response, you need to contact WEA ASAP to enforce your contract rights. Your building administrator is not required to inform you of your rights. It is up to you to Know Your Contract!
