ARTICLE 9 – Right to Representation (Teachers)
Article 9 Except in cases of emergency, when a principal plans to take disciplinary action against a teacher, the teacher shall be so informed and may request that an Association representative be present before the conference commences. Whenever legal proceedings are commenced regarding the matter in question, by other than the Association counsel, all rights under this Article shall cease.
WEA ESP Staff: While there is no similar language in the ESP contract, courts have ruled that whenever an employee has a reasonable fear that discipline may be imposed, the employee has a right to Union representation. Management has not denied an employee representation when they have asked for it. But please remember that management is not required to tell you of this right. You must ask for representation.
What if my request is for representation is denied?
If management refuses to allow representation, the employee must still attend the meeting. However, in response to each question the employee should always respond that they wish to have WEA representation before answering any question.
Do I have to be a member to get representation?
Yes. WEA provides representation and legal services only to members. And generally you must have been a member for at least 30 days.
As with many other rights you have under the contract, the district is not obligated to inform you of your rights. It is up to you to Know Your Contract.
