Know Your Contract Cum Leave - Maternity Leave What benefits are available for maternity leaves?
WEA teachers have one of the very few contracts in Colorado that does not use a combination of sick leave and a few personal days. Under ARTICLE 22 – Cumulative Leave Article 22 A teacher receives between eleven and sixteen cumulative leave days each year based on their years of service. These days can be used for any purpose, including maternity leave. A teacher may also accumulate up to 25 additional days. Therefore, a teacher can begin a school year with up to 41 workdays of paid leave. If the teacher has any additional frozen sick leave days, these may also be used. In addition, under the Family Medical Leave Act (FMLA), teachers are entitled to six weeks unpaid leave for maternity leave. The District is required to continue to pay medical benefits during this leave.
Finally, if a teacher has complications and it is medically necessary for her to be on leave for longer than six weeks, a teacher who is a member of the sick leave bank may get additional days from the bank to cover the absence.
All benefits available for maternity leave are also available for adoption.
WEA ESP staff have similar benefits to teachers and they may use any of their cumulative, vacation, sick or personal days accrued. They are also entitled to FMLA leave and to use their sick leave bank if medically necessary. Nine, ten and eleven-month employees earn 11 cumulative days. An ESP who is a regular part-time shall receive cumulative leave on a pro-rated basis according to the number of hours their work per day Twelve month employees earn 13 days of cumulative leave each year. All ESP employees can accumulate up to 15 of these days. As with many other rights you have under the contract, the district is not obligated to inform you of your rights. It is up to you to Know Your Contract.
